1. Who you are contracting with

These Terms & Conditions ("Terms") govern your use of the website and services provided by zcvisuals ("we", "us", "our"). By accessing the website, creating an account, or purchasing a service, you agree to these Terms.

2. The service

zcvisuals provides AI-powered video production, custom voiceover, and video editing services delivered remotely. Specific deliverables, turnaround times, and revision rounds are described on the relevant service or order page.

3. Eligibility and account

You must be of legal age to enter into a contract or, if purchasing on behalf of an organisation, you must have authority to bind that organisation. You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable use

You agree to use the service only for lawful purposes and in accordance with these Terms. You are solely responsible for all content you submit and all activity conducted through your account. You must not, and must not permit any third party to:

  • Unlawful activity: use the service for any unlawful, fraudulent, deceptive, or misleading purpose, or in violation of any applicable local, national, or international law or regulation (including export controls and sanctions);
  • Harmful content: create, upload, request, or distribute content that is defamatory, obscene, pornographic (including any sexual content involving minors), hateful, harassing, threatening, violent, discriminatory, or that incites violence or self-harm;
  • Deception and impersonation: impersonate any person or entity, misrepresent your affiliation, or create deepfakes, synthetic media, voice clones, or likenesses of real people without their explicit, documented consent;
  • Spam and unsolicited communications: send spam, chain letters, phishing, or any other unsolicited or unauthorised commercial communications;
  • Intellectual property: infringe, misappropriate, or violate any patent, trademark, trade secret, copyright, right of publicity, privacy right, or other intellectual property or proprietary right of any third party; upload content you do not own or have express permission to use;
  • Privacy violations: collect, harvest, or process personal data of others without a lawful basis or required consent;
  • Regulated or high-risk uses: use the service in connection with weapons, illegal drugs, gambling where prohibited, adult services, political disinformation, election interference, or any application requiring regulated professional advice (legal, medical, financial) without appropriate human oversight;
  • Security and integrity: introduce viruses, malware, worms, or other harmful code; probe, scan, or test the vulnerability of the service or any related system; bypass, disable, or interfere with security or authentication features; conduct denial-of-service attacks; or scrape, crawl, or harvest data without authorisation;
  • Reverse engineering: reverse engineer, decompile, disassemble, or attempt to derive the source code of the service, except to the extent expressly permitted by law;
  • Resale and abuse: resell, sublicense, or redistribute the service or deliverables outside the licence granted; share account credentials; or use automated means to access the service in a manner that imposes an unreasonable load on our infrastructure;
  • Circumvention: circumvent, disable, or attempt to bypass any usage limits, rate limits, content filters, or technical restrictions of the service.

We reserve the right to investigate and take appropriate action against any suspected violation, including removing content, suspending or terminating accounts without refund, and reporting activity to law enforcement. Repeated or serious violations will result in permanent termination.

5. Payments, billing, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. By completing a purchase, you also agree to Paddle's Buyer Terms, which govern payment, billing, taxes, subscription renewals, cancellations, and refunds.

Some services are billed as a 50% deposit at order with the remaining balance due before final delivery. Subscriptions renew automatically until cancelled. See our Refund Policy for our money-back guarantee.

6. Intellectual property

We retain all right, title, and interest in the website, our software, branding, templates, and documentation. Subject to payment in full, you receive a non-exclusive, worldwide licence to use the final delivered video files for your stated commercial or personal purpose. You retain ownership of the original content you submit (briefs, footage, brand assets) and grant us a limited licence to host and process it solely to deliver the service.

7. AI-generated content

Our service may use generative AI tools to create or assist in creating video, audio, and visual content. You agree:

  • not to request content that is illegal, defamatory, hateful, sexually explicit involving minors, or designed to deceive (deepfakes of real people without consent, impersonation, fraud);
  • that you are responsible for the prompts and reference materials you provide and that you have the necessary rights to them;
  • that AI outputs may be inaccurate or imperfect and should be reviewed before public use; AI-generated outputs are not suitable as a substitute for regulated professional advice (legal, medical, financial);
  • that we may refuse, filter, moderate, or remove outputs that violate these Terms or applicable law, and may suspend accounts for repeat infringement.

8. Service level and warranties

We aim to deliver high-quality work within the stated timeframes but do not guarantee that the service will be uninterrupted, error-free, or that delivery deadlines will always be met where delays are caused by client feedback, third-party tools, or events beyond our reasonable control. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with these Terms is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify us against claims arising from content you submit, your use of the deliverables, your breach of these Terms, or your violation of any law or third-party right.

11. Suspension and termination

We may suspend or terminate your access to the service, without refund where lawful, if you: materially breach these Terms; fail to pay amounts due; pose a security or fraud risk; or repeatedly or seriously violate our acceptable use rules. You may stop using the service at any time. Subscription cancellations are handled through Paddle.

12. Consequences of termination

On termination, your right to use the service ends immediately. We will retain order and account data as described in our Privacy Notice. You may request export or deletion of your project content within 30 days of termination.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or by notice on the website. Continued use after changes take effect constitutes acceptance.

14. Force majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, war, civil unrest, government action, internet or infrastructure outages.

15. Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

16. Governing law

These Terms are governed by the laws of the jurisdiction in which zcvisuals is established, without regard to conflict of law principles. The courts of that jurisdiction have exclusive jurisdiction over any disputes, except where mandatory consumer protection law provides otherwise.
